OVERVIEW
Wickes Media, Inc. doing business as USA Supernet [hereinafter referred to as "USA Supernet"] provides Web hosting and other Internet related services. By using our services you, the subscriber, agree to comply with our policies with respect, courtesy, and responsibility for the rights of Internet users and other subscribers of our services. The provisions herein are intended as guidelines and are not meant to be exhaustive. Generally, conduct that violates law, regulation, or the accepted norms of the Internet community, whether or not expressly mentioned in this Policy, is prohibited.

SERVICE
USA Supernet services are generally available upon receipt of payment. Some services may require setup and/or installation. The estimated time before the service is available to you after purchase can be found in the description of the service which you can view on our website prior to purchase.

The USA Supernet hosting service is engineered to deliver the highest level of network uptime and availability. USA Supernet guarantees a network uptime of 100%. Network downtime is defined as 100% packet loss occurring in the transmission of data (packets) from our server to the Internet backbone. In the event network uptime is not 100%, credit will be issued to the customer upon request for the actual downtime. Suspected downtime must be reported via email to support@usasupernet.com and must be verified by at least two (2) trace routes from independent locations. Downtime will be measured from the time the outage is reported to the time the server is able to transmit and receive data again.

USA Supernet operates a shared hosting service, which means that multiple subscribers are hosted from the same server and share server resources. Our hosting is designed to meet the typical needs of small business subscribers in the United States. It is NOT intended to support the sustained demand of large enterprises, internationally based businesses, or non-typical applications better suited to a dedicated server. USA Supernet reserves the right to limit processor time, bandwidth, or processes in cases where it is necessary to prevent negatively impacting other subscribers.

Use of USA Supernet services is at your sole risk. USA Supenet shall not be responsible for any damages your business may suffer, nor makes any warranties of any kind, expressed or implied for services we provide including merchantability or fitness for a particular purpose. This includes loss of data. Our server backup service is provided to you as a courtesy. USA Supernet is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.

USA Supernet reserves the right to refuse service to anyone for any reason.

UNACCEPTABLE USE
USA Supernet proudly provides superior Internet business solutions for merchants to conduct and promote their products and services. The guidelines outlined in this section are intended to prevent system abuse, illegal activities and business practices that do not meet USA Supernet's ethical standards.

USA Supernet services may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. Further, the use of our services to infringe upon any copyright or trademark is prohibited.

Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting. USA Supernet reserves the right to terminate, without notice, any account which has been the target of a Denial of Service or similar type attack.

Directly or indirectly transmitting or supporting the transmission of unsolicited email messages, including, without limitation, commercial advertising and informational announcements, is expressly prohibited. Nor shall a subscriber use another site's mail server to relay mail.

Engaging in any activity that, in USA Supernet's sole discretion, disrupts, interferes with or is harmful to the services, business, operations, reputation, and goodwill of USA Supernet or the ability of USA Supernet's subscribers to effectively use the services is prohibited.

Examples of prohibited content and practices on USA Supernet servers include but are not limited to: Topsites, IRC scripts/bots, proxy scripts/anonymizers, pirated software, image hosting scripts, AutoSurf/PTC/PTS/PPC sites, IP scanners, spam scripts, commercial banner ad rotation, file dump/mirror scripts, commercial media streaming, pornography, high-yield interest programs (HYIP), prime banks programs, lottery sites, commercial game sites, sites promoting illegal activities, bank debentures/bank debenture trading, fraudulent sites. If in doubt, it is the responsibility of you, the subscriber, to verify with USA Supernet in advance that your content and business activities are acceptable.

When USA Supernet becomes aware of Unacceptable Use, we will initiate an investigation. During the investigation USA Supernet may restrict the subscriber's access to the service(s) in order to prevent further possible unauthorized activity. Depending on the severity of the violation, USA Supernet may, at its sole discretion, restrict, suspend or terminate the subscriber's service or entire account and/or pursue other civil remedies. Criminal activities will be reported to the appropriate law enforcement agencies.

ACCOUNT BILLING & PAYMENT
USA Supernet accepts the following forms of payment:
  • Credit cards (Visa, Mastercard or Discover)
  • Visa or Mastercard Debit cards
  • Company checks (subject to credit approval)
  • Money orders
As a courtesy and not as an obligation (contractual or otherwise), all services, including domain names, will automatically renew at the end of the billing cycle until the service(s) is/are formally canceled. While consenting to USA Supernet's performance of automatic renewal, you hereby release USA Supernet from all liability for its failure, for any reason, to renew a service, account or domain.

Most USA Supernet services, such as Web hosting and Internet access, are priced per month. Subscribers who pay for monthly services with a credit or debit card will be billed monthly. Subscribers paying by check or money order will be billed quarterly. Other services, such as domain names and SSL certificates, will renew for the same duration initially selected, at the then-current, non-promotional rate, by charging the applicable fee to your originally-selected method of payment. Billing and payment information is available by accessing your account on the usasupernet.com website. Paper invoices or statements are available only to accounts paying by check or money order.

Payments are due on or before the due date. By providing USA Supernet with your credit card or debit card information, you authorize USA Supernet to automatically charge your credit or debit card for all recurring and one time fees which apply to your account. You are responsible for updating or notifying USA Supernet of any changes to your credit card such as card number, expiration date, billing address or any other change. If USA Supernet is unable to charge the renewal fee to your credit card, for whatever reason, said service(s) or domain name will expire at the end of their respective billing cycle.

Accounts that are five (5) days past due will be automatically suspended. If your payment by check or money order is habitually late, USA Supernet reserves the right to demand that your account be setup for payment by Credit Card or Debit Card. If you do not voluntarily agree to change your payment method, your service(s) will expire at the end of their respective billing cycle.

If an email requesting a service cancellation is sent to billing@usasupernet.com at least 10 days prior to the end of the service billing cycle, the service will expire at the end of the billing cycle. If the service is canceled with less than 10 days before the end of the billing cycle, the service will expire at the end of the next billing cycle. Cancellation of services does not relieve you from paying any outstanding balance owed. USA Supernet reserves the right to cancel any service, without notice.

Any equipment provided to you, the subscriber, in order for you to use and/or benefit from the service and that equipment being the property of USA Supernet, said property must be returned to the offices of USA Supernet at your expense within thirty (30) days from the date that service is terminated. The equipment must be returned complete with all parts, cables, power supplies and other accessories originally sent to you. You will be billed for any equipment or part thereof not returned within the allotted 30 days.

The only acceptable method to dispute a service charge is to contact the Billing Department at USA Supernet within 90 days from the date of the charge. USA Supernet has a zero tolerance policy for credit card charge-backs. A fee of $50.00 will be assessed to any subscriber who initiates a credit card charge-back in lieu of contacting the Billing Department. Disputes for charges over 90 days old will not be accepted.

INDEMNIFICATION
You, the subscriber, agree that you shall defend, indemnify, save and hold harmless USA Supernet from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against USA Supernet, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by you, your agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless USA Supernet against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with USA Supernet; (2) any material supplied by you infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from USA Supernet's server.

MODIFICATION
USA Supernet reserves the right to add, delete, or modify any provision of this Policy at any time, without notice.
